1. Agreement to Terms

By accessing or using SecureKit ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

2. Description of Service

SecureKit provides an API service for email and IP address validation. The Service includes:

  • Email address validation and verification
  • IP address validation and security analysis
  • Access to validation results via API endpoints
  • Documentation and support resources

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. Account Registration

To use the Service, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and API keys
  • Accept responsibility for all activities that occur under your account
  • Be at least 18 years old or have the legal capacity to enter into contracts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Payment Terms

Payments for SecureKit services are processed through Paddle.com ("Paddle"), our payment service provider. By purchasing our services, you agree to Paddle's terms and conditions.

4.1 Subscription Plans

We offer various subscription plans with different usage limits and features. Subscription fees are billed in advance on a recurring basis (monthly or annually) as specified in your chosen plan.

4.2 Pricing Changes

We reserve the right to modify our pricing at any time. Price changes will be communicated to you at least 30 days in advance. Continued use of the Service after the price change constitutes acceptance of the new pricing.

4.3 Payment Processing

All payments are processed securely through Paddle. You agree to provide accurate and complete payment information. We are not responsible for any issues arising from payment processing by Paddle.

4.4 Failed Payments

If payment fails or is declined, we may suspend or terminate your access to the Service until payment is successfully processed. You are responsible for any fees charged by your financial institution.

5. Usage Limits and Restrictions

Your usage of the Service is subject to the limits and restrictions specified in your subscription plan:

  • API request limits per billing period
  • Rate limiting to prevent abuse
  • Prohibited uses as outlined in Section 6

Exceeding your plan limits may result in additional charges or service suspension. We reserve the right to modify usage limits at any time.

6. Prohibited Uses

You agree not to use the Service:

  • For any unlawful purpose or in violation of any laws
  • To transmit any viruses, malware, or harmful code
  • To attempt to gain unauthorized access to the Service or related systems
  • To abuse, harass, or harm others
  • To reverse engineer, decompile, or disassemble the Service
  • To resell or redistribute the Service without authorization
  • To use automated systems to exceed reasonable usage limits
  • To interfere with or disrupt the Service or servers

Violation of these prohibitions may result in immediate termination of your account without refund.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by SecureKit and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your business purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance
  • Technical issues or failures
  • Force majeure events
  • Third-party service disruptions

We are not liable for any damages resulting from Service unavailability. We will make reasonable efforts to restore service promptly.

9. Cancellation and Termination

9.1 Cancellation by You

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of your current billing period.

9.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in prohibited activities.

9.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account data in accordance with our Privacy Policy. You will not be entitled to any refund for unused portions of your subscription unless otherwise specified.

10. Refund Policy

All refunds are processed through Paddle in accordance with their policies and applicable laws.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECUREKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless SecureKit and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Sending an email to your registered email address
  • Displaying a notice within the Service

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

  • Paddle handles payment processing, invoicing, and tax collection
  • You may be subject to Paddle's refund and cancellation policies

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and SecureKit regarding the Service and supersede all prior agreements and understandings.
